Implicaciones jurídicas de la construcción de puerto brisa en el municipio de Dibula - la Guajira

Abstract

La empresa portuaria Brisa S.A le ha apostado al desarrollo del sector económico en Colombia con el proyecto de construcción del Puerto Multipropósito Brisa en el municipio de Dibulla – la Guajira. Este Megaproyecto fortalecerá la infraestructura de transporte mejorando la capacidad portuaria del país, a su vez generará una considerable fuente de empleos en la región. Sin embargo, a pesar de estas ventajas, el puerto ha tenido una serie de inconvenientes relacionados con los derechos de los pueblos indígenas de la zona donde se construye, tales como la consulta previa y el derecho al territorio; además de la afectación de los ecosistemas vulnerables que podría generar su ejecución. Por lo anterior, y a solicitud de las autoridades de las comunidades indígenas de la Sierra Nevada de Santa Marta, la Corte Constitucional se manifestó ordenando el respeto de los derechos de estos y el cumplimiento de los postulados constitucionales; lo que generó la suspensión de actividades de la construcción del puerto. Es por ello que se justifica la realización de la Tesis de Grado denominada “Implicaciones jurídicas de la construcción de puerto brisa en el municipio de dibulla - la Guajira”.

Due to the economic development Colombia has showed in recent years the portuary company Brisa S.A decided to invest in the country in the construction of a multipurpose port in the municipality of Dibulla- Guajira. This megaproject presents the community with the benefiting aspect of improving the transportation infrastructure in the zone thus increasing Colombia’s portuary capacity. In the mean time, this project would generate a considerable amount of jobs for the regions’ people. On the other hand, even though the project brings a good set of benefits, there have been some community-related-issues. For instance, the main concern facing the megaproject at this stage is about the indigenous peoples and their rights upon the territory wherein the building of the port would take place, and the lack of consideration of their opinion about this soon to be port. In addition to that, there is also apprehension about the damaging of the ecosystem present in the area where the port will be built. As a result to these concerns, and to the petitions of the local indigenous communities of La Sierra Nevada de Santa Marta, the Constitutional Court manifested its presence by ordering the portuary company to respect the rights of the neighboring communities and to abide to the constitutional laws, thus generating the suspension and bringing to a hold all construction and activities in the site. Therefore, this is why I have chosen to focus my graduation thesis on this matter, and for which I have titled “JUDICIAL IMPLICATIONS OF THE BRISA PORT CONSTRUCTION IN THE MUNICIPALITY OF DIBULLA – GUAJIRA”.
