Eficacia del sistema de responsabilidad penal del adolescente frente a la prevención de la delincuencia juvenil en la ciudad de Bucaramanga para el periodo 2008-2014

Abstract

La presente investigación titulada eficacia del sistema de responsabilidad penal del adolescente frente a la prevención de la delincuencia juvenil en la ciudad de Bucaramanga para el periodo 2008-2014, tiene como finalidad hacer una lectura reflexiva sobre la situación actual del sistema de responsabilidad penal adolescente respecto de los resultados obtenidos en la prevención de la delincuencia juvenil, y por tanto, el análisis de la reincidencia de los adolescentes en la ciudad de Bucaramanga. Para tal fin, y desde la investigación jurídica, de tipo cualitativo, y la revisión documental y normativa del fenómeno de estudio, se realizó un estudio normativo de la finalidad del SRPA, la responsabilidad de las autoridades y entidades en el funcionamiento efectivo del SRPA, la descripción de cómo opera la función preventiva del sistema, y finalmente el número de delitos que se han presentado en el Municipio cometidos por adolescentes. Se pudo determinar que las medidas administrativas y correctivas implementadas en el marco del Sistema de Responsabilidad Penal para Adolescentes, no son suficientes ni las apropiadas para contrarrestar las dimensiones y la magnitud de la problemática de la delincuencia juvenil, lo que genera una sensación de ineficacia del sistema, concretamente de su función preventiva.

This research titled effectiveness of the system of criminal liability teenagers from the prevention of juvenile delinquency in the city of Bucaramanga for the period 2008-2014, it aims to make a thoughtful reading on the current situation of the system of adolescent criminal responsibility the results obtained in the prevention of juvenile delinquency, and therefore the analysis of recidivism of adolescents in the city of Bucaramanga. To this end, and from legal research, qualitative, and the document review and regulation of the phenomenon of study, a normative study of the purpose of SRPA was made, the responsibility of the authorities and the effective functioning of the SRPA, describing how the preventive function operates the system, and finally the number of crimes that have occurred in the municipality committed by teenagers. It was determined that the administrative and corrective measures implemented under the Criminal Responsibility System for Adolescents, are not sufficient or appropriate to counter the size and magnitude of the problem of juvenile delinquency, creating a sense of ineffectiveness system, specifically its preventive function.
