Análisis de la novela El proceso de Kafka desde el libro vigilar y castigar de Michel Foucault

Abstract

El presente proyecto surgió de las necesidades de comenzar a llenar un vacío con respecto a las investigaciones sobre la relación entre derecho y literatura e impulsar este tipo de investigaciones. Se buscó realizar una crítica al derecho y sus instituciones, especialmente el derecho penal, desde la literatura y la filosofía, cuestionando sus conceptos. Para ello se analizó la novela El proceso del escritor Franz Kafka desde la teoría jurídica planteada por Michel Foucault en su obra Vigilar y castigar. A partir de una cuidadosa lectura y relectura de las dos obras se prosiguió a describir detalladamente en qué consiste cada una. Así se describió capítulo a capítulo la trama de la novela El proceso, centrando la atención es los hechos de relevancia jurídica. Por su parte Vigilar y castigar fue descompuesto en sus principales unidades temáticas, logrando narrar y esquematizar el proceso evolutivo del derecho penal desde el siglo XVII hasta el siglo XX. Por último se procedió buscando hallar los puntos de articulación entre las dos obras, para ello se acudió a material literario, filosófico, fílmico y periodístico a fin de enriquecer y contextualizar la investigación y lograr señalar, de manera breve, los vínculos del derecho con la literatura. Los puntos de encuentro entre las dos obras se ven resumidos en cuatro puntos esenciales: el poder: cómo se ejerce, cómo se produce y cómo se legitima, la sociedad disciplinaria: el tipo de sociedad en la que se encuentra el protagonista de la novela y que es descrita por Michel Foucault, la culpa: su concepto, su origen, su función y su relación con la locura, y por último el lenguaje jurídico: el derecho como hecho lingüístico, el derecho como idioma del poder y el silencio de las víctimas del poder. This project arose from the need to start filling a void with respect to research on the relationship between law and literature and encourage this type of research. We sought to critique the law and its institutions, especially the criminal law, from literature and philosophy, questioning its concepts. For this novel was analyzed The process by writer Franz Kafka from the legal theory put forth by Michel Foucault in his book Discipline and punish. From a careful reading of the two works he continued to describe in detail what each one. So chapter to chapter described the plot of the novel process is focusing the facts of legal significance. For its part Discipline and punish was decomposed into its main thematic units, achieving narration and outline the evolutionary process of criminal law since the seventeenth century to the twentieth century. Finally we proceeded seeking to find the points of articulation between the two works, it will be turned to literary, philosophical, cinematic and journalistic material to enrich and contextualize the research and achieve point, briefly, the links between law and literature. The points of contact between the two works are summarized in four essential points: the power: how it is exercised, how it is produced and how it legitimizes, the disciplinary society: the type of society that is the protagonist of the novel and which is described by Michel Foucault, the fault: the concept, its origin, its function and its relationship with madness, and finally the legal language: the right as a linguistic fact, the law as the language of power and silence of victims power.
