Consideraciones jurídicas respecto a la acción oblicua, subrogatoria e indirecta

Abstract

Con el propósito de entender los derechos crediticios del acreedor, es necesario orientar, que mediante la presente investigación que se realiza a la figura de la acción oblicua, subrogatoria o indirecta es un instrumento que permite garantizar sus derechos mediante el cumplimiento de las obligaciones del deudor. En donde se entra a estudiar la naturaleza de la acción oblicua, subrogatoria o indirecta, en los procesos de ejecución en Colombia. La investigación tiene como proceso metodológico el sistemático en el cual se le da sentido a la ley respecto a las actuaciones generadoras de derecho situadas en la norma, y que a manera de interpretación, se logra esclarecer con los elementos conceptuales de la estructura normativa; y el teleológico pues a se ha de desentrañar el fin normativo, el espíritu de la ley y el objetivo que persigue, con el propósito de aumentar el conocimiento y esclarecer la norma desconocida o tal vez olvidada en el derecho. De lo expuesto en el trabajo de grado se concluye la imperfección inherente al mecanismo de la acción oblicua, subrogatoria e indirecta que no da al acreedor demandante ninguna ventaja en particular y además, lo expone a sufrir la insolvencia del deudor al hacer concurrir a los demás acreedores. En suma la acción oblicua o subrogatoria o indirecta, no tiene un ejercicio expedito y es la razón por la cual su uso se ha hecho prácticamente inocuo y no ha logrado el desarrollo, ni jurisprudencial, ni practico en el derecho privado colombiano.

With the proposition to identify the loan rights of creditor, is necessary guide the position, the that by the present investigation that is realize to the figure of the action oblicua ,subrogation or indirection with the instrument which enables the guarantee the rights with the thought meet the compact and the obligations with the debtor. Where the side to enter to studied the nature and the action of oblicua, subrogation and indirection, in the process of the execution of Colombia. The investigations have a process methodological system by the side of the law respect the acts generating in the rights situated in the law, and for interpreted we can establish, we can clear up with the elements conceptual for the structure of law; and the teleological that is to found the end of the normative, and the spirits of the law and the objective that follow, with the propose that grow the knowledge and clear up the law unknown or maybe forget the human right. Of the above in the job for the grade as going for the conclusion that the imperfection inherent the mechanism of the action oblicua, subrogation and indirection that not care to the creditor that demand for any advantage in order, is exposed to suffer an inability for the debtor that have the creditors. In the sum of the action of the oblicua or subrogation and indirection , not have an exercise clean and this is the reason by the used that have inocuo and not have a developing ,jurisprudential and practice in the right privacy Colombian.
