Responsabilidad de los agentes del Esmad y del Estado por la vulneración de derechos humanos a civiles (1999-2020)

Abstract

El presente trabajo investigativo se enfoca en la responsabilidad que puede derivarse de las conductas violatorias de derechos humanos ejercidas por el Escuadrón Móvil Antidisturbios, donde se han visto involucradas un importante número de víctimas. De la consecutiva violación de derechos humanos por parte del ESMAD hacia la población civil colombiana desde el año 1999 hasta el 2020, se analizará en el presente trabajo las diferentes regulaciones normativas del ESMAD, con el fin de entender el contexto en el que se han presentado estos hechos y poder comprender cuál es la responsabilidad de los agentes del ESMAD y del Estado por las graves violaciones de derechos humanos, toda vez que resulta preocupante como se ha generado una percepción negativa de dicha institución y también una desconfianza al sistema judicial colombiano debido a que las garantías de muchas víctimas se ven dilatadas por las falencias del sistema. This research focuses on the responsibility that can be derived from the human rights violations committed by the Mobile Anti-riot Squadron, in which a significant number of victims have been involved. From the consecutive violation of human rights by the Smad against the civilian population from 1999 to 2020, this paper will analyze the different normative regulations of the Smad, in order to understand the context in which these events have occurred and to understand what is the responsibility of the Smad agents and the State for the serious violations of human rights, It is worrisome how a negative perception of this institution has been generated, as well as a distrust of the Colombian judicial system due to the fact that the guarantees of many victims are delayed because of the system's shortcomings.
