Alternativas jurídicas para la disposición final de los residuos sólidos en el área urbana del municipio de Piedecuesta

Abstract

El Municipio de Piedecuesta puede verse abocado a una grave emergencia sanitaria si en el transcurso del último plazo hasta el 30 de septiembre de 2015 no encuentra una alternativa, ya sea de forma individual o junto a los demás municipios del Área Metropolitana de Bucaramanga, a la necesidad de darle el manejo adecuado desde el punto de vista técnico y normativo al manejo de las basuras de Piedecuesta. Este plazo se fijó como resultado de las mismas Resoluciones 1045 de 2003, 1390 de 2005 y 1684 de 2008 del Ministerio de Ambiente, respecto a los procesos de cierre de los rellenos sanitarios que no cumplen con las condiciones estipuladas en las mismas. Igualmente la CDMB, en cumplimiento de lo dispuesto a nivel nacional por el Ministerio de Ambiente, expidió la Resolución No. 001328 mediante la cual ordenaba el cierre definitivo del Carrasco el 16 de marzo de 2011, la cual técnicamente significaba el cierre definitivo de la celda transitoria de disposición final habilitada en la cárcava uno. Luego a raíz de la declaración de emergencia sanitaria por parte del Municipio de Bucaramanga, dada por el Decreto No 0234 de 2011 y las sucesivas prórrogas hasta extender este estado de excepción hasta la fecha vigente. Por lo tanto, se hace urgente el planteamiento de alternativas de solución a esta problemática coyuntural, desde diferentes perspectivas, entre ellas las jurídicas. Encontrar dichas soluciones jurídicas, plenamente ligadas con las otras dimensiones (técnica, comunitaria, política), conllevará a que se posibilite encontrar la mejor alternativa para que el Municipio de Piedecuesta siga manejando con calidad todo el proceso de recogida y depósito de sus residuos sólidos. Con lo cual los más de 130.000 habitantes que residen en la localidad, tendrán la plena seguridad que sus derechos sanitarios y ambientales no serán afectados de forma negativa.
