Diagnostico jurídico de la sentencia sl2885-2019 aplicado en la fundación SIAM

Abstract

Este proyecto de investigación busca determinar si la Fundación para el Servicio Integral De Atención Medica (SIAM) tiene una contratación adecuada para sus trabajadores de acuerdo a la sentencia sl2885-2019 de la Corte Suprema de Justicia. Con el fin de dar un diagnostico de la contratación de la Fundación SIAM, este trabajo efectúa un estudio del contrato de prestación de servicios, contrato de trabajo y contrato realidad iniciando con sus definiciones, especificaciones y diferencias y continuando con el análisis la de la sentencia Sl2885-2019 del diecisiete (17) de julio de dos mil diecinueve (2019) de la Corte Suprema De Justicia. Igualmente, evalúa los contratos de la fundación SIAM y sus manuales de funciones de la mano con la información obtenida de la Sentencia Sl2885-2019 y de los contratos de prestación de servicios y contratos de trabajo. Asimismo, se estudian los errores o puntos por mejorar de la fundación con el fin de ofrecer recomendaciones, debilidades, oportunidades, fortalezas y amenazas ofreciendo la oportunidad de mejora y evitar sanciones futuras. This research project seeks to determine if the foundation SIAM has an adequate contract structure for its employees, following to the sentence s12885-2019 dictated by the Supreme Court of Justice. For the stated purpose this research project does a study of all the contracts that are under service providers, work contracts and reality contracts beginning with its definitions, specifications and differences, continuing with the analysis of the sentence S12885- 2019 from 17 of July 2019 from the Supreme Court of Justice. Furthermore, it evaluates the contracts of the foundation SIAM and its functions manuals, together with the information obtained from the sentence S12885-2019 and from the contracts already reviewed. Likewise, it studies the mistakes found in these contracts and gives these recommendations about flaws and opportunities of improvement that might prevent future legal penalties.
