La regla de reconocimiento de Hart y su debate con R. Dworkin, perspectiva desde la academia colombiana

Abstract

Este artículo realiza un análisis desde el modelo de normas jurídicas que H.L.A. HART construye en su obra el Concepto de Derecho así como las principales críticas de su antagonista R. Dworkin; contextualiza la obra junto a la del Dr. Cesar Rodríguez importante expositor de la doctrina nacional con la firme intención de acercar el debate un poco más al escenario jurídico cotidiano. Sin perder la altura del debate planteado por dos de los más grandes teóricos del derecho en el siglo XX se quiere obtener una proyección de la academia, al vincular permanentemente a la realidad la estructuración Hartiana, también presenta las matices mas relevantes del debate con el norteamericano R. Dworkin. La consideración de analizar los principios y las reglas para un Estado Social de Derecho nos invita a una nueva lectura de los sistemas jurídicos contemporáneos.

This article make an analize since a form of law rules than H.L.A. Hart build in his text The Right´s Concept, as the principal criti... of his opositor R. Dworkin, do the context with the book of César Rodriguez, important author of the national doctrine This paper presents an application of a methodology of the “Delphy” type or experts’ advice which g to identify and prioritize strategic project that involve three important actors: the academy, the company and the state. This methodology helps to project the role of the academy in the society, relate its tasks with the community demands, thus generating a quality investigation pertinent to the manufacturing sector. The main objective of this methodology is to enhance and make more efficient the Academy-Company-State.
