Dificultades y retos y de la Justicia Transicional en Colombia: aprendizajes adquiridos para futuras transiciones

Abstract

El conflicto armado en Colombia ha sido una constante histórica. A pesar de la implementación de dos sistemas de justicia transicional que operan de forma paralela, como Justicia y Paz, y el Sistema Integral de Verdad, Justicia, Reparación y No Repetición, la violencia persiste y los grupos armados continúan activos. Esta investigación busca abordar la teoría, legislación y reconstruir un relato con el objetivo de analizar los retos en la implementación de la justicia transicional para alcanzar la tan anhelada paz en Colombia, tras la desmovilización de los dos grupos armados más grandes que han operado en el territorio nacional, las FARC-EP y las AUC. Además, se proyecta hacia el futuro, considerando un eventual cese de hostilidades con el ELN y otros actores, en el marco de la política de “Paz Total”. The armed conflict in Colombia has been a historical constant. Despite the implementation of two transitional justice systems operating in parallel—Justice and Peace and the Comprehensive System of Truth, Justice, Reparation, and Non-Repetition—violence persists, and armed groups continue to exist. This research aims to explore theory and legislation and reconstruct a narrative to analyze the challenges in implementing transitional justice as part of Colombia's long-awaited pursuit of peace after the demobilization of the two most prominent armed groups to have operated in the national territory, the FARC-EP and the AUC. Additionally, it looks to the future, considering a potential cessation of hostilities with the ELN and other groups under the framework of the “Paz Total” policy
